The actual area of these lots as converted in Building Lots is 301,687 Sq.feet and I submit that that is the area! that should be taken. I cannot accept such a high valuation" as 54 cents a Sq. foot but will meet you half way by split- ting the difference between my valuation and yours and making it 45 cents a Sq. foot.

LAND TO BE GIVEN UF BY THE COLONY.

I accept your corrected area and valuation. I do not admit that the foreshore comprised in the area is of only nominal value. But I am prepared to give way on this point in order to make the valuation balance as nearly as possible in the interests of a speedy and amicable settle- ment.

1 accept the area of 3,350 acres of hilly ground, but I must except from it an area of 200 acres comprising a reservoir site and catchment area immediately below the Sai Kung Road near the point where it crosses the water parting between the valleys draining to east and west.

This is known as Source No. 5 among the sources of laten Supply for Kowloon enumerated in the report on the Kowloon Water Supply by Lawrence Gibbs dated the 8th, January, 1900, and it is certain that a reservoir will be required at this spot for the population or industrial enterprises which will grow up along the foreshore between Kowloon City and Lyemun.

GENERAL.

In respect of the areas to be transferred to the War Department both at Devil's Peak and Nog Tau Kok it must be stipulated that their surrender do not convey with it the water or other rights which are usually reserved to the Crown in Crown Leases, and that the Colonial Government must have the right to construct works within the areas for utilising the water which may be derived from them,
